(1) Every act of malicious injury to property punishable under this Act, shall be an offence so punishable, whether the property belonged to a private person, or to Her Majesty, or was otherwise of a public nature. (2) Every act of malicious injury done to property by any person, with intent to injure or defraud another, shall be an offence within this Act, although the offender was, at the time of its commission, in lawful possession of such property.
