Crimes Act 1900 (NSW) - Section 195
Actual malice.
195. On the trial of a person for any such act as is referred to in section
194, it shall not be necessary to prove the existence of malice, either
against the owner of the property, or against any other person:
Provided that:
No act shall be deemed malicious which was done by the accused under a
reasonable supposition that he had a right to do such act.
